Agreement to Terms

By engaging Joe Souza Construction, Inc. for construction services, or by using our website, you agree to be bound by these Terms and Conditions. These terms apply to all services provided by our company and constitute a legally binding agreement between you and Joe Souza Construction, Inc.

Services Provided

Joe Souza Construction provides comprehensive construction services including but not limited to:

• Residential construction and custom home building
• Commercial construction projects and build-outs
• Renovation and remodeling services
• Kitchen and bathroom remodeling
• Emergency repair services
• Consultation and project planning services
• Permit acquisition and inspection coordination

All services are subject to separate written contracts that will specify the scope of work, timeline, and pricing.

Estimates and Contracts

We provide free estimates for all construction projects. Please note that:

• Estimates are valid for 30 days from the date provided
• Final pricing may vary based on actual conditions discovered during work
• All work requires a signed contract before commencement
• Changes to the original scope of work require written approval and may affect pricing
• We reserve the right to refuse any project at our discretion

Payment Terms

Payment terms will be specified in individual project contracts. Our standard terms include:

• A deposit may be required before work begins (typically 10-25% of project cost)
• Progress payments are tied to specific project milestones
• Final payment is due upon project completion and your satisfaction
• We accept cash, check, and major credit cards
• Late payments may incur additional charges as specified in the contract
• Liens may be filed for unpaid balances as permitted by law

Warranties and Guarantees

We stand behind our work and provide warranties as follows:

• Workmanship warranty: 1-2 years depending on the type of work performed
• Material warranties are provided by manufacturers and vary by product
• Structural work may carry extended warranties as specified in contracts
• Warranty coverage excludes normal wear and tear, misuse, or damage from external factors
• Warranty claims must be reported promptly and in writing

Client Responsibilities

As our client, you agree to:

• Provide accurate information about your project requirements
• Ensure access to the work site during agreed-upon hours
• Make timely payments according to the contract terms
• Obtain any required approvals from HOAs or other authorities
• Communicate any concerns or changes promptly
• Maintain insurance on your property during construction
• Remove or protect personal belongings in work areas

Limitation of Liability

Our liability is limited as follows:

• Total liability shall not exceed the contract value of the specific project
• We maintain appropriate insurance coverage for all construction activities
• We are not liable for delays caused by weather, permit issues, or client changes
• Consequential or indirect damages are excluded from our liability
• Claims must be made within one year of project completion

Permits and Compliance

We handle permit acquisition and ensure compliance with local building codes. However, clients are ultimately responsible for ensuring all necessary approvals are obtained. We will coordinate inspections and work with local authorities to ensure all work meets or exceeds applicable standards.

Dispute Resolution

Any disputes arising from our services will first be addressed through direct communication. If resolution cannot be reached, disputes may be subject to mediation or arbitration as specified in individual contracts. These terms are governed by the laws of the State of California.

Changes to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with a new "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
